1. About These Terms

These Terms of Use govern your access to and use of this website and any membership application or member-only area operated under the CULTUR3 name. By using the website, you agree to these terms. If you purchase a ticket, the Purchase Policy also applies; if there is a conflict concerning a purchase or event, the Purchase Policy takes priority. Nothing in these terms excludes or limits any right or remedy that cannot lawfully be excluded or limited.

2. Eligibility and Membership

You must be at least 21 years old to apply for membership or attend an age-restricted CULTUR3 event. We may request satisfactory proof of age, identity, eligibility, or account ownership at any time. An application, previous acceptance, invitation, access link, or prior attendance does not create an entitlement to membership, future invitations, tickets, or entry. To the fullest extent permitted by law, we may accept, reject, review, suspend, withdraw, or impose reasonable conditions on membership or access at our discretion and without being required to provide reasons. You must ensure that information you provide is accurate, current, and not misleading, and notify us of any material change.

3. Communications

We may use the contact details you provide to send service, security, membership, transaction, ticket, or event administration messages where reasonably necessary. We will send electronic marketing only where we have an appropriate legal basis and, where required, your consent. Marketing consent is voluntary and is not a condition of membership or purchase. Message frequency may vary and your network provider's charges may apply. You can withdraw consent or opt out at any time by using the unsubscribe method in the message, replying STOP to an SMS where supported, or contacting us. Reply HELP for SMS assistance. An opt-out will not prevent non-marketing messages that are reasonably necessary to administer an application, transaction, ticket, event, or legal obligation.

4. Acceptable Use

You must use the website only lawfully and for your own personal, non-commercial purposes. You must not misuse the website; attempt to gain unauthorised access; interfere with its security, operation, or other users; introduce malicious code; scrape, harvest, copy, or systematically extract data or content; impersonate another person; submit unlawful, infringing, abusive, fraudulent, or misleading material; circumvent access or ticket controls; or use the website, membership, invitations, or ticket links for resale, promotion, or another commercial purpose without our prior written permission. We may investigate suspected misuse and cooperate with relevant service providers, venues, payment providers, or authorities where lawful and appropriate.

5. Intellectual Property

The website and all rights in its branding, names, logos, text, graphics, photographs, recordings, software, layout, and other content belong to CULTUR3 or its licensors. We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the website for its intended personal purpose. Except where law permits otherwise, you must not copy, adapt, publish, distribute, commercially exploit, reverse engineer, remove rights notices from, or create derivative works from any part of the website without the relevant owner's prior written permission. No ownership or other rights are transferred to you.

6. Availability, Changes, and Security

The website is provided on an "as available" basis. We do not guarantee that it, or any content, function, invitation, link, or member area, will always be available, uninterrupted, secure, compatible, or error-free. We may change, correct, withdraw, suspend, restrict, or discontinue any part of the website or access to it at any time, with or without notice where reasonably practicable. You are responsible for your own device, connection, security, backups, and for keeping access links or credentials confidential. You must promptly tell us if you suspect unauthorised use.

7. Information and Third-Party Services

Website content is general information only and is not advice on which you should rely. Although we may update or correct content, we do not promise that it is complete, current, or free from errors. Event, venue, performer, price, availability, and timing information may change and is subject to the Purchase Policy and the information given for the relevant event. Links, embeds, payment facilities, social platforms, venue services, and other third-party content or services are provided for convenience; unless expressly stated, we do not control, endorse, or assume responsibility for them or their terms, availability, security, or privacy practices.

8. Our Responsibility

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory rights, or any other liability that cannot lawfully be limited. Subject to that, we are not responsible for loss or damage that was not reasonably foreseeable when you began using the website, arises from your breach or misuse, results from matters outside our reasonable control, or consists of business loss, loss of profit, revenue, opportunity, goodwill, or data. The website is supplied for private use; if you use it for a trade or business purpose, you do so at your own risk and, to the fullest extent permitted by law, we exclude liability for resulting business losses.

We may suspend, restrict, or terminate your use of the website or member access immediately where we reasonably believe this is necessary to protect CULTUR3, an event, a venue, another person, or our systems; to investigate suspected fraud, misuse, or breach; to comply with law or a third-party requirement; or because you have breached these terms. Rights and provisions which by their nature are intended to continue after termination will remain in effect.

We may amend these terms from time to time to reflect changes to the website, our services, our business, technology, security, or the law. The updated version will apply from the date shown on this page. Where a change materially affects an existing paid booking, we will apply it only to the extent permitted by law and the Purchase Policy. You should review these terms periodically.

11. General

If any provision is unlawful or unenforceable, it will be treated as modified to the minimum extent necessary, or removed if modification is not possible, without affecting the remaining provisions. A delay in enforcing a right is not a waiver. You may not transfer your rights or obligations under these terms without our prior written agreement; we may transfer ours as part of a transfer of our business or services, provided this does not reduce your mandatory legal rights. No person other than you and CULTUR3 has a right to enforce these terms.

12. Governing Law and Contact

These terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, except that a consumer resident elsewhere in the United Kingdom may also bring proceedings in their home courts and retain any mandatory protections of the law applicable to them.
